1. Agreement to Terms

Welcome to Blue Grub Farms LLC ("Blue Grub Farms," "we," "us," or "our"). By accessing or using our website at www.bluegrubfarm.com (the "Site") or purchasing any products from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or purchase our products.

We reserve the right to update or modify these Terms at any time. Changes become effective when posted to this page. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

2. Products and Descriptions

Blue Grub Farms sells Black Soldier Fly Larvae (BSFL) farming equipment, live and dried BSFL, pet treats, and soil amendment products. We make every effort to ensure that product descriptions, images, and pricing on the Site are accurate. However, we do not warrant that descriptions or other content are error-free, complete, or current.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. If a product is listed at an incorrect price due to a typographical error or systems error, we reserve the right to cancel any orders placed at the incorrect price.

3. Live Animal Products

Some of our products include live insects (BSFL, BSF pupae). By purchasing live products, you acknowledge and agree to the following:

• Live arrival is not guaranteed once the package leaves our facility. We pack carefully to maximize survival rates, but shipping conditions (temperature, handling, transit time) are outside our control.
• Live insect orders are shipped on days and schedules that optimize arrival conditions. We may delay shipment if weather conditions pose a risk.
• You are responsible for understanding any local regulations regarding the possession or release of Black Soldier Flies in your area.

4. Orders and Payment

All orders are placed through our Site and processed via Squarespace's integrated payment platform, which supports major credit cards and other payment methods. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

An order confirmation email does not constitute acceptance of your order. Your order is accepted when the product ships.

5. Shipping

We ship to addresses within the United States. Shipping times and costs are calculated at checkout and depend on the products ordered, destination, and shipping method selected.

Once an order has shipped, you will receive a tracking number via email. Blue Grub Farms is not responsible for delays caused by carriers, weather, customs, or other events beyond our control.

Risk of loss and title for items purchased from the Site pass to you upon delivery of the items to the carrier.

6. Returns and Refunds

Due to the nature of our products, our return policy varies by product type:

• Hardware products (Bin Kit, The Coop, Clippie, and similar items): May be returned within 30 days of delivery in unused, original condition. Contact us at grubbear@bluegrubfarm.com to initiate a return. Buyer is responsible for return shipping costs.
• Live products (live BSFL, pupae): Due to their perishable nature, live products are non-refundable. If you receive dead-on-arrival insects, contact us within 24 hours of delivery with photos and we will work with you to find a resolution.
• Consumable products (dried BSFL, Grumbles, Frassquatch products): Non-returnable once opened. Unopened products may be returned within 30 days of delivery. Contact us to arrange a return.

Refunds are processed to the original payment method within 7-10 business days of receiving the returned item.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, product designs, and software — is the property of Blue Grub Farms LLC or its content suppliers and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

8. User Conduct

You agree not to use the Site in any way that:

• Violates any applicable local, state, national, or international law or regulation
• Infringes the rights of any third party
• Attempts to interfere with the proper functioning of the Site
• Introduces viruses, malware, or other harmful material
• Attempts to gain unauthorized access to any portion of the Site or its systems

9. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied. Blue Grub Farms does not warrant that the Site will be uninterrupted, secure, or error-free.

We do not make any warranties regarding the results of using BSFL products for composting, animal feed, or any other purpose. Results vary depending on environmental conditions, setup, and management practices.

10. Limitation of Liability

To the fullest extent permitted by law, Blue Grub Farms LLC, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Blue Grub Farms LLC and its owner, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Site, your purchase or use of our products, or your violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Arapahoe County, Colorado.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
